WhatsApp for Client Communication: What Law Firms Need to Get Right

21 August 2026 · 5 min read

The default is already WhatsApp

Most Indian clients already expect case updates over WhatsApp, whether or not a firm has formally decided to offer that channel. The practical question for most firms isn't whether to use WhatsApp - it already happens informally - but whether to leave it running through individual advocates' personal numbers or bring it under firm-level structure.

What tends to go wrong with the informal version

When client communication runs through a personal number, three things tend to happen: the firm loses visibility into what was actually communicated and when; documents get shared as raw attachments rather than access-controlled links, increasing exposure if a phone is lost or compromised; and continuity breaks if the advocate handling a matter is unavailable, because the thread lives on their personal device, not in a firm-level record.

What a firm-level approach needs to get right

A properly run firm WhatsApp channel needs: a business-verified number (via WhatsApp Business or the Cloud API) rather than a personal one; secure, expiring links for document sharing instead of raw file attachments; a clear opt-out mechanism, since automated updates without consent risk both client frustration and platform policy violations; and language support that actually matches how clients communicate, not just the advocate's default.

It's also worth being explicit with clients that WhatsApp updates don't, by themselves, create or guarantee any form of legal privilege over that channel - that's a legal question distinct from which app is used to communicate.
